注册其关系的同居配偶可豁免12个月关系要求

主要变化：
从2009年11月9日起，移民条例将被修改。在照新的条例下，按所规定的州或领地法律注册其关系的同居配偶将豁免期关系已存在至少12个月的要求。
以下法律及关系符合要求：
| Victoria | Relationships Act 2008 - a registered relationship that is registered under s10 (3) (a) of that Act. 注册关系 |
| Tasmania | Relationships Act 2003 - a significant relationship as defined in s4 of that Act. 重要关系 |
| ACT | Civil Partnerships Act 2008 - a relationship as a couple between 2 adults who meet the eligibility2个成年人之间符合要求的配偶关系 |
改修改适用于2009年11月9日 及之后递交的申请。
金桥顾问点评：
该变化无疑对希望通过同居配偶关系申请相关签证（学生签证，配偶签证，技术移民签证等）的申请人带来益处。最主要的就是同居不到12个月的申请人可以递交相关申请。
1. 这是否意味着通过同居配偶关系申请签证变得很简单了？
金桥顾问认为，同居时间要求虽然豁免，但审查力度可能会反而加大，就像现在的570签证，要求虽然无雅思年龄等限制，审查力度却很大。因为此次修改的只是移民条例（Reg 2.03A），没有修改移民法（Migration Act)，所以移民法中关于事实关系（De Facto Relationship) 的要求没有变，仍然要求证明其关系的真实性和持续性等。这就意味着需要准备的文件仍然会比较繁杂。
2. 维多利亚的“注册关系”
2.1 申请注册“可注册关系”
处在“可注册关系”中的申请人如符合以下条件，可申请注册其关系：
(a) 是本州居民或长住居民
(b)没有结婚或没有处在注册关系中，而且
(c)不在另外一个可以按本规定注册的关系中
2.2 “可注册关系”的定义：
“可注册关系”是指两个成年人之间的一种关系（非注册关系），关系双方没有结婚，但其中一方或双方在具有家庭性质的个人或财务及支持方面，为另外一方提供实质性益处，无论性别，或是否住在一起。但不包括一方在以下情况下为另外一方提供家庭支持及个人照顾的关系：
(a) 有偿提供; 或
(b) 代表他人或组织
“registrable relationship means a relationship (other than a registered relationship) between two adult persons who are not married to each other but are a couple where one or each of the persons in the relationship provides personal or financial commitment and support of a domestic nature for the material benefit of the other, irrespective of their genders and whether or not they are living under the same roof, but does not include a relationship in which a person provides domestic support and personal care to the other person—
(a) for fee or reward; or
(b) on behalf of another person or an organisation (including a government or government agency, a body corporate or a charitable or benevolent organisation);”
2.3 申请注册的要求：
申请人需提供以下文件：
(a) 申请人双方各提供一份法律声明，声明：
(i) 同意注册
(ii) 没有结婚或没有处在注册关系中，而且
(iii)不在另外一个可以按本规定注册的关系中
(b)身份及年龄证明
(c) 申请费
(d) 其他注册处要求的文件
